Fresno has a long swimming season and a lot of back yard pools, and the rules for the barrier come from the state. California's Swimming Pool Safety Act says that when a building permit is issued to build or remodel a pool or spa at a single-family home, the pool must have at least two of seven listed drowning prevention features (Health and Safety Code section 115922). An enclosure that separates the pool from the house is one of them. A fence around the yard alone does not put anything between the back door and the water.

The same law spells out what an enclosure must be (section 115923). It is at least 60 inches high. The gap under it is no more than 2 inches. No opening lets a 4-inch ball through. The outside has nothing a small child could use as a handhold or foothold. Gates open away from the pool, close and latch by themselves, and the latch sits at least 60 inches above the ground. The building inspector for your city or for Fresno County checks these points and may ask for more.

Most pool enclosures here are aluminum or ornamental steel, because the pool stays in view from the house and the metal does not mind splash or sun. Mesh panels and solid vinyl are other options. In a flood-irrigated yard or on soil that settles, the 2-inch gap at the bottom is the measurement that drifts first, so we set the line with that in mind. We also look for things next to the fence that defeat it: a block planter, an air conditioning unit, a stack of firewood.

Does my back yard fence count as the pool fence?

It can count as the yard's perimeter, but the state law is about isolating the pool from the home. If the house opens straight onto the pool, you need another listed feature, such as an inner enclosure, door alarms or an approved cover. The building department decides what it will accept.

How tall does a pool fence have to be in California?
